Merrill v. Milligan and Merrill v. Caster
Section 2 of the Voting Rights Act (VRA) prohibits a state from using voting practices and procedures that “result[] in a denial or abridgment of the right…to vote on account of race or color.” This means that results are the legal standard, not another factor, such as intent to discriminate. This case asked the Court to explore the ongoing constitutionality of the Section 2 and the standards to review challenges to electoral districts.
