Lange v. California
Late in the evening on October 7, 2016, Arthur Lange was driving home, playing music loudly, and unnecessarily honking his car horn several times. California highway patrol officer Aaron Weikert followed Lange, suspecting him of committing a noise infraction. As Lange pulled close to his home, Weikert activated his police lights. Weikert then entered Lange’s garage, believing, on probable cause, that Lange failed to obey a lawful order and obstructed a peace officer, both misdemeanors, by failing to stop when Weikert turned on his lights. Weikert saw signs that Lange was intoxicated, and a later test revealed that Lange’s blood-alcohol level exceeded the limit for driving. Lange was charged with driving while intoxicated. Lange moved to suppress the evidence that Weikert discovered after entering Lange’s garage without a warrant.
